BetterHelp owes clients $7.8M after FTC affirms information misusing

BetterHelp, one of the largest online therapy platforms, has been ordered to pay $7.8 million in restitution to its customers after the Federal Trade Commission (FTC) alleged that the company mishandled sensitive user data protection. The settlement was announced on February 22, 2023, and comes after a year-long investigation by the FTC.

The settlement requires BetterHelp to pay back customers who used the platform between January 1, 2019, and January 31, 2023. The company must also implement a comprehensive data security program to prevent future mishandling of user data.

What is BetterHelp?

BetterHelp is an online platform that connects users with licensed therapists and counselors for virtual therapy sessions. The platform is designed to provide affordable and accessible mental health services to people who might not otherwise have access to therapy.

Since its founding in 2013, BetterHelp has become one of the most popular online therapy platforms. With over 2 million users and more than 20,000 licensed therapists on its platform. The company’s services are available to users in the United States, Canada, Australia, and the United Kingdom.

The FTC’s Allegations:

The FTC’s investigation into BetterHelp began in January 2022. After the agency received complaints from users about the company’s handling of their data. According to the FTC’s complaint, BetterHelp made several false and misleading claims about its data security practices, including:

Claiming to use “military-grade” encryption to protect user data when, in fact. It used an outdated and easily exploitable encryption method.

Claiming to comply with the Health Insurance Portability and Accountability Act (HIPAA) when, in fact, it did not meet the standards required by the law.

Failing to adequately disclose its data-sharing practices with third-party service providers.

The FTC alleged that these misleading claims and omissions led users to believe that their data was more secure than it actually was.

Data Mishandling and Its Consequences:

The FTC’s investigation also found that BetterHelp failed to take reasonable steps to protect user data from unauthorized access. Specifically, the company did not:

Implement basic security measures, such as two-factor authentication, to prevent unauthorized access to user accounts.

Encrypt user data stored on its servers, making it vulnerable to hacking and data breaches.

Train its employees on data security best practices or conduct regular security audits.

As a result of these failures. The FTC alleged that BetterHelp put the personal and sensitive information of its users at risk. This information included users’ mental health history, treatment plans, and communications with their therapists.

BetterHelp’s Response to the Allegations:

In response to the FTC’s allegations. BetterHelp issued a statement acknowledging its shortcomings and committing to implementing a comprehensive data security program. The company stated that it takes the privacy and security of its users’ data seriously and that it regrets any harm caused by its past practices.

BetterHelp also noted that it had already taken steps to address some of the FTC’s concerns before the settlement was reached. For example, the company had already implemented two-factor authentication and had begun encrypting user data protection stored on its servers.

Lessons Learned:

The BetterHelp case highlights the importance of proper data security practices. Particularly in industries that handle sensitive user data, such as healthcare and mental health services. The case also demonstrates the importance of regulatory oversight to ensure that companies are held accountable for their actions.

As the use of online therapy platforms continues to grow it is essential that users can trust that their data is secure and protected. This requires companies to take proactive steps to safeguard user data and to be transparent about their data practices.

In addition, users should be aware of the potential risks of using online therapy platforms and should take steps to protect their data protection. This can include using strong passwords, enabling two-factor authentication, and being cautious about sharing sensitive information online.

The BetterHelp case is also a reminder that companies should not make false or misleading claims about their data security practices. This not only puts users at risk but can also lead to legal consequences and damage to the company’s reputation.

In conclusion, the FTC’s settlement with BetterHelp sends a clear message to companies that mishandling sensitive user data will not be tolerated. While BetterHelp has committed to implementing a comprehensive data security program and it is ultimately up to companies to take responsibility for protecting user data and to prioritize the privacy and security of their users. As users, we must also be vigilant and take steps to protect our data and hold companies accountable for their actions.
