The FTC’s Allegations:

The FTC’s investigation into BetterHelp began in January 2022. After the agency received complaints from users about the company’s handling of their data. According to the FTC’s complaint, BetterHelp made several false and misleading claims about its data security practices, including:

Claiming to use “military-grade” encryption to protect user data when, in fact. It used an outdated and easily exploitable encryption method.

Claiming to comply with the Health Insurance Portability and Accountability Act (HIPAA) when, in fact, it did not meet the standards required by the law.

Failing to adequately disclose its data-sharing practices with third-party service providers.

The FTC alleged that these misleading claims and omissions led users to believe that their data was more secure than it actually was.

Data Mishandling and Its Consequences:

The FTC’s investigation also found that BetterHelp failed to take reasonable steps to protect user data from unauthorized access. Specifically, the company did not:

Implement basic security measures, such as two-factor authentication, to prevent unauthorized access to user accounts.

Encrypt user data stored on its servers, making it vulnerable to hacking and data breaches.

Train its employees on data security best practices or conduct regular security audits.

As a result of these failures. The FTC alleged that BetterHelp put the personal and sensitive information of its users at risk. This information included users’ mental health history, treatment plans, and communications with their therapists.

BetterHelp’s Response to the Allegations:

In response to the FTC’s allegations. BetterHelp issued a statement acknowledging its shortcomings and committing to implementing a comprehensive data security program. The company stated that it takes the privacy and security of its users’ data seriously and that it regrets any harm caused by its past practices.
